TERMS & CONDITIONS

These terms apply to every booking with JM Production Group Pty Ltd (“JM Production”, “we”, “us”). “You” means the person or couple named on the booking. Your booking confirmation sets out your date, package, inclusions and price; these terms set out how we work together. By paying the deposit or signing the booking, you agree to them.

1. Securing your date

  • Your date is reserved once you have signed your booking and paid the deposit shown on it.
  • Until the deposit is paid, the date remains open to other clients.
  • Quotes are valid until the date stated on the quote.

2. Payment

  • The deposit is non-refundable. It compensates us for reserving your date exclusively and declining other work.
  • The remaining balance is due on or before the event date.
  • If the balance is not paid, we may pause work on your project and withhold delivery until it is paid in full.
  • Prices include GST unless stated otherwise.

3. What your package includes

  • Your booking lists the package and inclusions we will deliver. Anything not listed is not included.
  • Coverage beyond the agreed hours is charged at our hourly rate per team member, confirmed with you before the extra time begins, where our schedule allows.
  • Travel beyond 50 km from Melbourne CBD, accommodation and parking or venue fees are charged at cost and agreed in advance.
  • Changes to your package are welcome up to 14 days before the event and are confirmed in writing with an updated price.

4. Changing the date or cancelling

  • If you postpone, we will transfer your deposit once to a new date within 12 months, subject to our availability. If we are not available on the new date, it is treated as a cancellation.
  • If you cancel, the deposit is not refunded. If you cancel within 30 days of the event, the full balance remains payable, because we are unlikely to rebook the date.
  • If we cannot attend for a reason within our control, we will arrange a replacement team of equal standard. If we cannot, we will refund everything you have paid.
  • If the event cannot go ahead for reasons outside everyone’s control, such as a government restriction, severe weather or venue closure, we will move your booking to a new date at no charge.

5. On the day

  • Please give us an accurate schedule, venue addresses and a contact person at least 14 days before the event.
  • We are not responsible for moments missed because of late running, venue or celebrant restrictions, obstruction by guests, or a lack of cooperation.
  • You are responsible for any permits or venue permissions needed for filming and photography.
  • Live streaming depends on the internet connection at the venue, which we do not control.
  • Drone footage is subject to weather, airspace rules and venue permission, and may be omitted for safety reasons.
  • For coverage longer than 6 hours, please arrange a meal and a short break for our team.
  • Our team may stop work if they are subjected to unsafe conditions or abusive behaviour.

6. Delivery

  • Edited photos and films are delivered within 6 weeks of your event. In peak season, slight delays may occur and we will let you know.
  • Delivery is by the method shown on your booking, such as an online link or USB.
  • Same-day edits and social media reels are delivered as described in your package.

7. Review and changes

  • You have 14 days after delivery to request changes.
  • One round of reasonable changes is included, such as correcting a name or replacing a clip. Re-edits of style, structure or music are quoted separately.
  • If we do not hear from you within 14 days, the project is considered final and approved.

8. File storage

  • Raw footage is kept for 6 months after your event.
  • Final edited files are kept for 12 months after delivery.
  • After these periods files may be permanently deleted. Please keep your own backup as soon as you receive your files.
  • Raw footage is not included in delivery unless your package says so.

9. Creative control

You are booking us for our style. JM Production keeps creative direction over shooting, editing style, music choice and final presentation. We welcome your preferences and must-have moments, and will do our best to include them.

10. Copyright and use of your film

  • JM Production owns the copyright in all photos and footage.
  • You receive a licence to view, share and print them for personal use. Commercial use, or editing by another business, needs our written permission.
  • We may use selected photos and footage in our portfolio, website and social media. If you would prefer we do not, tell us in writing at any time and we will respect that.
  • Music in your film is licensed for personal viewing. Some social platforms may mute or restrict videos that contain commercial music.

11. Liability

  • We use professional equipment and carry backups. In the unlikely event of equipment failure, loss or damage of footage, our liability is limited to the amount you have paid for the affected service.
  • We are not liable for indirect loss, such as the cost of restaging an event.
  • Nothing in these terms excludes, restricts or modifies any right you have under the Australian Consumer Law.

12. Your information

We handle your personal information as described in our Privacy Policy at jmproduction.com.au/privacy-policy.

13. General

  • Your booking and these terms are the whole agreement between us. Changes must be agreed in writing, and email counts.
  • These terms are governed by the laws of Victoria, Australia.
